Using Modemkiller Art in Commercial Products

The commercial licence is available to all of our active patrons on our commercial licence tier, ‘Patron of Commerce’.

Definition of 'Modemkiller Art'

We define 'Modemkiller art' as any artworks released on our website www.modemkiller.com, any artworks released on our Patreon www.patreon.com/modemkiller, or any artworks released on our brand social media channels.

Use in Digital Publications

To use our artwork in your adventures, supplements, modules, or other digitally published materials, you must include the artwork in its original form without modification. There are two exceptions to this:

• Digital publications made in black and white or single colour/hue may include artworks modified to greyscale or the relevant single-hue progression.

• You may resize and adapt the artwork to suit layout needs, such as by creating vignettes, provided that the modifications retain the original integrity of the art without any distortion of proportions.

Use in Publications for Print

This commercial licence does not extend to adventures, supplements, modules, or other physically printed publications. Commercial print projects including Modemkiller art require further explicit agreement directly from Modemkiller.

Commercial licences for print will be considered on a case-by-case basis. To be considered, enquiries for commercial print licences should be sent to us at create@modemkiller.com and should include an offer of either a flat fee or profit share agreement.

Attribution

If you use any Modemkiller art in your commercial products, you must include the following within the publication:

1. Accreditation to our brand as “Artwork by Modemkiller” with a link to "patreon.com/modemkiller" or “www.modemkiller.com” in the credits.

2. A legible Modemkiller brand watermark on the artwork.

3. Where possible, a link to "patreon.com/modemkiller" or “www.modemkiller.com” beneath or beside the artwork.

If your product is posted online, accreditation must also be included in the description of the post.

If your product is marketed online, accreditation must also be included in the description regardless of whether Modemkiller artwork is utilised in the marketing materials directly, complete with a tag linking to the relevant Modemkiller social media channels.

Restrictions on Use

• You may resize the artwork to suit your needs but may not otherwise modify, recolour, adapt, or disassemble it.

• You may not use Modemkiller art as the basis for physical or digital merchandise (e.g., t-shirts, mugs, prints).

• You cannot use the artwork (in whole or in part) as a trademark, logo, or for endorsing any goods/services.

• You are not permitted to sub-license, sell, or lease the artwork, nor transfer your rights under this agreement to third parties. This includes displaying the artwork for download on any website or reselling it as standalone items.

• Modemkiller art may not be used in any content promoting racism, homophobia, transphobia, or bigotry of any kind.

• Modemkiller must not be used in such a way that implies endorsement of your product without explicit permission.

NFTs and AI Art

Modemkiller does not permit the use of its art for minting NFTs or in training AI art models, nor in any product or company that uses NFTs or leverages AI art. We vehemently oppose these technologies as exploitative of visual artists and damaging to the integrity of visual arts communities and industries.

Audio & Video Streaming

If you plan to use Modemkiller art in a video, stream, or podcast, you do not need this commercial licence. However, attribution, as described in this licence, is still required in the description. You are expected to have purchased the relevant artworks as a standalone product from an official Modemkiller channel, or be an active patron of the commercial tier while streaming the art.

Further Use Requests

For any further use of full-resolution artworks (e.g., for a Kickstarter project), you must contact us directly for explicit permission. Enquiries will be considered on a case-by-case basis, and should include an offer of either a flat fee or profit share agreement.

Exclusive Use Requests

We do not offer exclusive use of pre-existing artworks or artworks included in this commercial licence under any circumstance. If you require artwork for exclusive commercial use, a commission quote can be discussed. Exclusive commercial use agreements will be included in the pricing structure for such commissions.
